State v. Repsher
State v. Repsher, 2025 UT App 50 (Harris, J.)
Criminal Law
The Utah Court of Appeals held:
- The district court did not abuse its discretion in admitting evidence. A party is not required to provide conclusive proof that evidence is authentic only evidence sufficient to support a jury finding of authenticity.
- Practice tip: An issue is preserved even when a party does not raise an objection if the trial court raises the issue itself, invites discussion, and then rules on it.
