After Mother was arrested, Children were removed from Father and Mother’s home. The juvenile court later adjudicated the children as “abused and neglected,” finding that both Mother and Father had drug-related issues. The juvenile court ordered Father to complete a substance abuse evaluation and submit to random drug testing. Father challenged the court’s disposition order and abuse determination. The Utah Court of Appeals affirmed, holding:
- Father only challenged the abuse determination and not the neglect determination. The juvenile court’s neglect determination is a separate and independent basis for its jurisdiction.
- The juvenile court’s finding regarding Father’s “drug-related issues” was not clearly erroneous on this record.
