State v. Cordova, 2023 T App 99 (Christiansen Forster, J.)

Cordova was denied bail pending trial on a felony charge of distribution of a controlled substance after the district court found that Cordova’s release would pose a danger to the community. The Utah Court of Appeals affirmed, holding:

  • Clear and convincing evidence existed that Cordova posed a substantial danger to the community because distributing drugs is a danger to the community.
  • Practice Tip: Failing to appear at one hearing, without more, may not be clear and convincing evidence that the defendant is a flight risk.
