Jones Waldo v. 3293 Harrison Blvd., 2023 UT App 8 (Christiansen Forster, J.)

Civil Procedure

During its client’s divorce proceedings, Jones Waldo filed a lien on a property owned by an LLC to which its client and the client’s wife were members. The property was under contract, and the purchasers-to-be canceled the sale. The wife sued the husband and Jones Waldo and filed two statements of discovery issues (SODI). The district court granted relief to the wife. On appeal, the Utah Court of Appeals reversed as to the second SODI, holding:

  • The second SODI was privileged. Neither Jones Waldo nor the husband waived the attorney-client privilege with regard to the requested documents.
